Acceptance of terms
By creating an account or using Gocabbi, you agree to be bound by these Terms. If you do not agree, please do not use the service.
What the service does
Gocabbi is software that lets you send SMS through Android handsets and SIM cards that you own and control. It is a tool you use to operate your own messaging; it is not a mobile network operator, not an SMS aggregator, and does not carry or deliver messages itself. Delivery, pricing and terms of carriage are between you and your mobile operator.
Accounts and eligibility
You are responsible for the accuracy of your information and for keeping your login credentials, API keys and paired devices secure. You must be legally able to enter into contracts to use the service.
Your messages and your recipients
You are solely responsible for what you send, to whom, and whether you were entitled to send it. That includes obtaining consent where the law requires it, honouring opt-out requests, respecting quiet hours and marketing rules in your jurisdiction, and complying with your mobile operator's own acceptable-use and fair-use terms.
Bulk or automated messaging may breach the terms of a consumer mobile plan. Checking that is your responsibility.
Fees
Subscription fees are charged in advance for the plan you select and are shown before you confirm. Fees are non-refundable except where required by law. Charges from your mobile operator for the messages you send are separate and are not collected by Gocabbi.
Acceptable use
You agree not to use Gocabbi to send unlawful, fraudulent, deceptive or unsolicited messages, not to impersonate another person or business, and not to attempt to disrupt the service or gain unauthorized access to it or to other customers' data.
Data ownership and export
Your business data remains yours. You may export it at any time, and we will make it available to you for a reasonable period after an account is closed before deletion.
Limitation of liability
The service is provided "as is" without warranties of any kind. Message delivery depends on your handset, your SIM, your operator and the recipient's network, none of which are under our control. To the maximum extent permitted by law, Gocabbi is not liable for undelivered or delayed messages, or for indirect or consequential damages arising from your use of the platform.
Termination
We may suspend or terminate accounts that violate these Terms or applicable law. You may stop using the service at any time.
Changes to these terms
We may update these Terms from time to time. Continued use of Gocabbi after changes take effect means you accept the revised Terms.
